This is my Privacy Policy

Pete Davis, Photography takes privacy and GDPR very seriously which is why this policy document has been produced. It describes the collection, use, and disclosure of any of your information when using Pete Davis Photography website or services.  The privacy policy applies to all information collected through my services, this includes terms of use. The idea of this policy is to make everything transparent and clear regarding how your personal data is processed, protected, and what is done with it.

GDPR – General Data Protection Regulations (Ruling by ICO from May 2018)

There are rules and regulations that govern how companies use and retain information. As a sole trader I am not exempt from those rules and would like to explain how I will use and store your information. The General Data Protection Regulation is a major step in digital privacy and is the result of a long process settled in European values. The legal articles in the Regulation aim at strengthening laws on data protection, thereby giving EU citizens control over their personal data. While emphasizing the ideas of freedom, security, and equality within the European Union. The Regulation will apply from the 25th of May 2018

What information is being collected? 

If you have sent me a web contact form submission asking for my availability and asking me about my wedding photography or other services. You are submitting to me information like your name/email/telephone number and other relevant information required about your big day or event.

 

How do I use your data? 

When someone visits my website, I use third-party services like Wix.com who is my website provider and is GDPR compliant. Wix may collect standard internet log information and details of visitor behavior patterns on my behalf. This gives me information about the number of visitors to the various parts of my site and allows me to work out where I need to make improvements. I cannot identify or make any attempt to find out the identities of those visiting my website. Once I have received your initial data inquiry I will contact you via phone or email and then we will proceed from there.  If you decide to use my services, I will store your data securely so that I can work professionally with you to complete your wedding or event as described. If for any reason you decide not to use my services I will delete all your details (email/or web contact form submission etc from my database and from my inbox within 3 months of your initial inquiry. Unless you have requested to stay on my mail opt-in list. If you have found an alternative photographer that meets your requirements elsewhere and you let me know I will delete your inquiry and data within 10 working days.


Who is collecting your data?

Pete Davis of Pete Davis Photography is classed as a data controller so we will collect data for the purpose of communication about your wedding or event. This is done via my website contact form, Facebook, email submission, or phone call. In addition. if anyone is viewing or ordering images from proofing galleries then order information ie names and addresses will be collected by third-party companies. For example Shootproof and Loxley Colour. This is for the purpose of printing your images and delivery details.

 

How is it collected and stored? 

Data is collected via my website web contact form submission, Facebook, Facebook messenger, WhatsApp, phone call, or email. If you enquire or book me for your wedding or event then for the most part any required or relevant information/data is and automatically imported into my business software management (lightblue). This software is installed on my personal (not shared) secure Mac computer. This is maintained by me and in addition, my business software management who securely back up any relevant data needed in case of my computer or hard drive fails. No other third parties are involved or have direct access to my computer. You can request to have any of this information or data removed at any time by contacting me in writing as soon as possible. However to complete any services you have booked with me I would need to be able to keep certain information in order to communicate and complete the task and work you have contracted me for. Some necessary information such as images is also stored and backed up onto my personal (non shared) external hard drive or secure cloud-based systems. This is for additional backup and security reasons.

Why is it being collected?

I need to retain some of your data ie name, address, and phone number to enable me to work with you up to and also after your wedding date or event. This information will not be used or passed on to any other company unless we are working with that company or person to complete your wedding or event. The data and information are retained by me as I need to be able to contact you in the lead up to your big day. In addition, as we work together to create your wedding images, proofing sessions, and album presentation. From May 2018  I will ask you to confirm you have read my privacy policy and GDPR so you are aware of its content and information before submitting an inquiry form or completing a booking/contract. In addition, you may be asked for further consent or information at a later stage which is relevant to the job.

 

How will it be used?  (Also see above).

None of your data/images will be used unless I have full permission and consent from you (as per my booking terms and conditions). This includes whether or not Pete Davis Photography will be allowed to showcase a selection of your images. This will be for my portfolio albums, Facebook pages, and other social media patforms. It is the purpose of promoting Pete Davis Photography and marketing my business. If you agree but then at any time in the future you or anyone connected with the wedding itself change their mind you or they have the right to request this data to be removed for which I will do so upon receiving a written request. Please note if the images have been re-shared by third parties on social media I have no control over removing them. In this case, you would need to contact the person/s sharing them or Facebook direct, 

 

From May 2018 you will be able to positively opt-in and give your consent or not at the time of booking and when signing the booking form/contract. If you have already booked my services and signed a contract/booking form prior to the 25th May 2018 you will be contacted again at some point either before or just after the wedding or event and asked to complete a tick box consent form allowing me to use or continue using such data/images for my business promoting and showcasing. This information will then be added to and form part of your existing contract with Pete Davis Photography.

Which third party suppliers/data processors do you use.

Pete Davis Photography uses several 3rd party suppliers which are GDPR compliant or working towards being GDPR compliant. My website is hosted Wix.com and for my business management, I use an externally hosted third party company called  (light blue software). They manage and administer my account. For online photo galleries, proofing, images sales including printing and delivery services I use third party companies Shootproof and Loxley color. For album Supplies, I use a third party supplier (based outside the EU) This particular supplier does not receive any personal client information from me whatsoever. Such as address, email, phone numbers this is because the album is manufactured and delivered directly to me at Pete Davis Photography for inspection before presenting to my clients.

 

What will be the effect of this on the individual concerned? 

I hope the effect will be positive and allow us to keep in regular contact during our working relationship.

 

Is the intended use likely to cause individuals to object or complain?

I cannot think of a reason for objection or complaint if we are working together. It is best practice to maintain some form of system to record details for the duration of our working relationship.

Can you supply me information on what data you have on me 

I am happy to explain all the steps I take when working with you and how and where your information is stored and used, at any time, If you require this information in writing I can do so free of charge within 1 month of asking. Please feel free to contact me if you have any questions at all. In addition, if you require all your data to be deleted off our computers, website, and hard disks etc..I will do this for you after discussing what exactly you want deleting.

 

Use of Cookies

Most web-based or internet-based businesses, apps, etc will use cookies in one form or another these days, the ones that spring to mind immediately are Google and Facebook analytics. These seem to be the standard “cookies” feature of all major web browsers.  You may choose to disable cookies through your own web browser’s settings. Disabling this function may diminish your experience on my website and some features may not work as intended.

 

Social Media 

If you send me a private or direct message via any of the social media platforms, I will store the message for 12 months unless I need to keep it for backup to our agreed conversations. It will not be shared with any other organizations. Social Media that you use may well track your viewing history but please be assured they are not sending your details to me.

If you are also kind enough to write to me I will be seeking your permission to share your comments in various other internet locations ie my website.
